(“Depix”, “our” or “we”), a company specializing in the development and marketing of web-based image editing platforms, takes your privacy and the protection of your personal information seriously. This Privacy Policy (the “Policy”) explains why and how we collect, use, share, host, transfer and protect (collectively, “Processing” or “Process”, including versions thereof) your Personal Information when you use our web platform available at https://depix.ai/ (our “Platform”). 

 

PERSONAL INFORMATION

For the purposes of this Policy, “Personal Information” means any information about an individual that directly or indirectly identifies that individual or that, individually or in combination with other information, identifies that individual. In general, Personal Information does not include business contact information, such as your name, title, or business contact information.

In the course of conducting our business and providing our services, Personal Information collected may include, but is not limited to, the following:

- Your image, if applicable;
- Your navigation on the Platform;
- Your contact information, such as your name and email address, in order to identify you and correspond with you;

- Your communication preferences, such as comments or survey responses;
- Any other Personal Information you have provided to us.

 

HOW DO WE COLLECT YOUR PERSONAL INFORMATION?

 

Directly from you

Generally, we obtain Personal Information that we need directly from you, for example, when you use our services or communicate with us.

 

With a legal basis such as your consent

The legal basis for Processing your Personal Information is generally consent, unless applicable law provides another permissible legal basis (for example, to comply with our legal obligations, where necessary to establish, exercise or defend a legal claim or legal proceeding).

 

Refusal of collection and withdrawal of your consent

You have the right, if you wish, to refuse the Processing of your Personal Information. You may also, at any time, and subject to reasonable notice and any applicable legal or contractual restrictions, withdraw your consent (if any) to the Processing of your Personal Information in our possession by contacting us. WHY DO WE COLLECT YOUR PERSONAL INFORMATION?

 

For limited and specific purposes

Personal Information collected by Depix may be used for the following purposes:

- Establishing and managing our relationship with you;
- Providing and maintaining the services requested, namely access to the Platform;
- Responding to your information requests;
- Responding to your requests for assistance;
- Enabling business development and marketing, including informing our current and future customers of our new offerings, with their prior consent;
- Study trends and generate statistics on use to improve the user experience on the Platform ;
- As permitted or required by any applicable legal or regulatory requirements or provision;
- Any other purpose to which you have consented

To send you the Messages 

If you have consented to receive such information, Depix may send you newsletters, e-mails, news about, among other new features or products, updates, contests, special offers and/or other written communications (“Messages”) regarding Depix’s services and/or products and/or third-party’s products or services. You may opt-out of receiving Messages as indicated in the “Contact Us” section or by following the instructions contained in the Messages. However, Depix may continue to send you Messages to inform you of available upgrades or critical technical issues related to the Platform, or to provide you with important information about your account (if any).

 

For secondary purposes

Depix may also aggregate and anonymize Personal Information you have provided in order to create statistical data that Depix may use to improve the Platform and train machine learning algorithms. Depix may also share this information with its partners. Such statistical data does not include Personal Information.

 

WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

Depix does not rent or sell any of your Personal Information to third parties and will not share it with third parties without your consent, unless required by law or as necessary for the purposes set out below.

 

With our employees

In the course of their work, our employees may need to access your Personal Information, for example, when you contact us or request technical support. Their access is limited to what is necessary to perform their duties. 

 

With our strategic partners

Depix may share your Personal Information with its partners to the extent that such disclosure is required to fulfill the Purposes. Depix may use third parties to facilitate its activities, such as online payment service providers, analytics and product’s growth service providers, or hosting service providers. As part of these activities, Depix’s service providers may have access to and use your Personal Information for a limited time. When Depix engages third parties to Process any Personal Information, Depix implements reasonable contractual and technical safeguards to ensure that such third parties keep all Personal Information they Process strictly confidential. Please note that these third parties may be located in locations other than your current location, in which case appropriate measures are taken by Depix, as described below in the section “Where is your Personal Information hosted and transferred?”.

 

Where required by applicable law

Depix may also share your Personal Information if required by law or in the good faith belief that such action is necessary to: (i) comply with applicable laws; (ii) comply with an order of a judicial authority of competent jurisdiction; (iii) comply with any legal process served on Depix; (iv) protect and defend the rights or property of Depix; (v) enforce or verify your compliance with agreements with Depix, if any; (vi) prevent fraud or other illegal activity perpetrated through the Platform; or (vii) act in urgent circumstances to protect the personal safety of users of the Platform or the general public.

 

When transferring a business

We may share your Personal Information without your consent when our operations require it (for example, in the event of a merger, acquisition, bankruptcy or sale of assets). In such circumstances, we may also share some or all of your Personal Information with the relevant third-party (or its advisors) for purposes of a due diligence process.

 

For other purposes with your consent

Where you have expressly consented to it, your Personal Information may be shared with other third parties. For example, there may be specific instances where additional terms and conditions apply and through these, we make it clear that specific third parties are Processing your Personal Information.

 

THIRD-PARTY SERVICES AND PLATFORMS

 

Links to third-party platforms 

We may include links on the Platform to third-party sites or services that we do not control, for example, if you use an integrated feature of Google or social networks (Facebook, Twitter, LinkedIn, etc.). These third parties may share certain information about you with us. Your activities on the Platform may be displayed on social network platforms. Please read the privacy policies of those sites, applications or platforms that may collect Personal Information to understand their privacy policies and Personal Information collection practices. This Policy applies only to Personal Information Processed by or on behalf of Depix.

 

Use of reCAPTCHA

We may use the reCAPTCHA service of Google LLC (“Google”) to verify whether data entered on the Platform was entered by a human or by an automated program. The reCAPTCHA service may collect information about you, including your Personal Information, for security purposes. Information collected by reCAPTCHA is maintained in accordance with Google’s privacy policy. By using the reCAPTCHA service, you consent to the processing of your Personal Information by Google in the manner and for the purposes described in its privacy policy.

 

HOW DO WE USE COOKIES?

A cookie is a small text file that is stored in a dedicated location on your computer, mobile device, tablet or other device when you use your browser to visit an online service. Other tracking technologies, such as web beacons and tracking pixels, may be used for similar purposes. In this Policy, all such tracking technologies are collectively referred to as “Cookie(s)”. Any Personal Information collected through the use of Cookies by or on behalf of Depix is treated with the same level of confidentiality as any other Personal Information held by Depix.

 

Strictly necessary Cookies

These Cookies are necessary for the operation of the Platform and cannot be disabled in our systems. Strictly necessary Cookies must be present in order for the Platform to provide basic functions; they may include logging in, adding items to a shopping cart or electronic billing. Where is your Personal Information stored and transferred?

Personal Information we collect is hosted in secure systems hosted on servers that may be located outside your province, territory, or country of residence, including in Canada, the European Union, Jordania, and the United States. We may also retain agents and service providers who may be located outside of Quebec. However, we strive to protect Personal Information in our custody, including Personal Information entrusted to an agent or service provider, whether they are located in Canada, the European Union, the United States, Jordania or other jurisdictions or countries. In particular, we strive to limit their access to Personal Information to that which is necessary to perform their assigned functions. Please be aware that we also strive to put in place contractual arrangements with these agents and service providers to ensure the confidentiality and security of your Personal Information. HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?

Your Personal Information will be retained only as long as necessary for the fulfillment of the Purposes for which it was collected, or in accordance with Depix’s legitimate interests, or to comply with applicable legal, tax or regulatory requirements. At the end of this period, we will endeavor to destroy or anonymize such information. 

In determining the appropriate retention period for your Personal Information, we consider the amount, nature and sensitivity of Personal Information involved, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the Purposes for which we Process your Personal Information and the possibility of achieving those Purposes by other means, as well as any applicable legal, tax or regulatory requirements. HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

 

With necessary and appropriate security measures

We strive to apply the necessary and appropriate security measures to ensure the confidentiality of Personal Information in our possession. In doing so, we follow generally accepted industry standards. Personal Information in our possession is therefore only accessible to those individuals who have the authority to access it and who only consult it when necessary for the performance of their duties. Appropriate physical, technical and administrative safeguards and security measures have been put in place and are maintained to minimize the risk of incidents. Children’s privacy

The Platform is only available to persons 14 years of age or older. Depix does not knowingly Process Personal Information from children under the age of 14, unless a parent or legal guardian has consented. WHAT ARE YOUR RIGHTS?

Depending on applicable law, you may have certain rights in relation to your Personal Information such as the right to portability and de-indexation of your Personal Information, the right to obtain access to or rectification of your Personal Information, the right to withdraw your consent (if any), the right not to be discriminated against, the right to restrict Depix’s Processing of your Personal Information, and the right to object to such Processing. POLICY CHANGES AND UPDATES

Depix may, at its discretion, update, revise, modify or supplement this Policy from time to time. If material changes are made to the Policy, you will be notified when you log in and/or we will send you a link to the new version of the Policy. The Policy and any related agreements, if any, will be posted on our Platform. Depix requests that its users review the revised Policy before continuing to use its Platform.
